Terms & Conditions - MBSS
1. Introduction
1.1 These Terms and Conditions outline the rights and responsibilities that you have with Mount Barker Swim School.
2. Parties to Terms and Conditions
2.1 The “Customer” means you; the person or party signing/agreeing to this Contract. “Mount Barker Swim School” means the organisation providing the service for which the customer is paying. The organisation is Mount Barker Swim School, 30 Simper Crescent, Mount Barker, South Australia, 5251, phone 08 8391 1213
3. Parental Supervision
3.1 It is a condition of entry to Mount Barker Swim School that all children under the age of 12 must be accompanied by a parent or responsible guardian that remains at Mount Barker Swim School with the child / children. Children must be collected by a parent or guardian at the end of their lesson.
3.2 A parent or guardian/s needing to leave during a child’s lesson MUST first advise reception staff and confirm all contact information we have on file is current. You MUST return at least 5 minutes before the end of the lesson to collect your child.
4. Illness and Swimming
4.1 Please do not bring a child or children to the Mount Barker Swim School if the child or children have any contagious condition. This can include, but is not limited to, nervous system infections, ear or eye infections, gastrointestinal infections, diarrhoea, cold or flu, cold sores, coughing, infectious runny noses (green discharge), open sores, skin infections, rashes, or feet infections.
5. Health Issues
5.1 Appropriate clean and suitable swimming attire is required for entry into the pool. If you are unsure, please ask a reception staff member.
5.2 Children up to the age of 24 months must wear bathers that have elastic waist and leg bands or ‘aqua nappies’.
5.3 Disposable or cloth nappies are not permitted in the pool.
5.4 Please use infant change tables provided.
6. Payments
6.1 All customers who have an active monthly booking must have a Direct Debit set up on their account. While you can pay in advance prior to the month beginning if you do not wish money to be deducted from your nominated account, a saved payment method is still required as security on your account. All failed payments will incur a Failed Payment Administration Fee of $15.00, which will be borne in full by the customer and added to the Family Account.
6.2 Failed payments can be paid with cash, credit card or cheque, either through the Customer Portal, the iClass Pro App or via the reception desk. Payments can also be made by credit card over the phone. Failed payments must be paid within the first seven (7) days of the month, or the booking will be automatically cancelled.
7. Dishonoured Payments
7.1 Should your payment be dishonoured; your Family Account will be debited a Failed Payment Administration Fee of $15.00.
7.2 In the event of a payment being dishonoured on three (3) consecutive occasions, Mount Barker Swim School reserves the right to terminate your Contract.
8. Additional Responsibilities
8.1 Customers are responsible for ensuring the nominated bank account or credit card has sufficient funds at least three (3) business days prior to the scheduled Direct Debit.
8.2 Customers are responsible for ensuring the nominated bank account or credit card accepts Direct Debit payments.
8.3 If the nominated bank account or credit card does not accept Direct Debit payments it is the customer’s responsibility to update their Direct Debit details in person or via the iClass Pro App.
8.4 Customers are responsible for updating their credit card details if their credit card is due to expire. All updates should be made at least three (3) business days prior to the Direct Debit date.
8.5 A Failed Payment Administration Fee of $15.00 will be added to the family account on each occurrence.
8.6 You are responsible for notifying us and/or updating your contact details and Direct Debit details as necessary via reception or the iClass Pro App. All updates should be made at least three (3) business days prior to the Direct Debit date.
9. Cancellation
9.1 A minimum 14 days' notice is required to cancel Mount Barker Swim School Learn to Swim lessons and Squad sessions. This can be done in person at Mount Barker Swim School, over the phone, via email or through the iClass Pro App.
9.2 Upon cancellation of either a Mount Barker Swim School Learn to Swim lesson or Squad session, any eligible make-ups remaining will be made inactive, due to no active booking. Remaining make-ups are not redeemable for cash or credit.
10. Increase in Fees and Change of Terms
10.1 Mount Barker Swim School may, at any time, provide fourteen (14) days' notice of any increase of fees charged by the swim school. Notification will occur by email and/or via an announcement through the iClassPro App.
10.2 Mount Barker Swim School retains the right to change any of these terms. If terms change, at least fourteen (14) days' notice of these changes will occur. Notification will occur by email and/or via announcements through the iClassPro App.
